Falsely accused of "Power gaming" - DAWWG - 11-26-2022

Reason for PK: "Power-Gaming"
Why should you be unPK'd?:
I was falsely accused of "Power-gaming", stating that I deceived the user into thinking he can store the vehicle that I sold him into the dealership. Before the sale, I explained that the car didn't have an "ownership" or "Insurance" and that the vehicle wasn't in my name. As you can see in the footage, I sold him the car in-character and used no methods of OOC to convince him to buy the car. In the admin situation, the user explained that I deceived him, then Rem said, "so that's power gaming" and after looking at the description of "Power-gaming" according to the server rules, "Powergaming = Forcing unfair actions against another person using OOC means. The claims that I power gamed in this situation is 100% false, I may have hustled the guy to buy a car that wasn't mine (all in character), but I never power gamed. I asked for video evidence of this happening, Rem said that "I admitted to power-gaming and that he doesn't need evidence. Lastly Rem gives me an ultimatum, either I give the money back that I "Power Gamed" for, or he will "PK" my character. I stood my ground and didn't give up the money because firstly, I never power gamed, and secondly, there was even evidence to make their claims off of, rather than their own biased opinions.
As I observed the situation, I feel that I was treated with prejudice by Rem. When he told me he didn't need video evidence, I was confused as many situations I've been in, you need some sort of physical evidence to base your claims on so the admins can gauge what really happened in the situation, but this time that wasn't the case. I should be un-PKed as I truly haven't broken any rules. I'd like to add to that prior to this situation, I haven't had one Ban or Warn on my record, as I do know and comply to all the server rules, as I have been enjoying this server since May 2021 with many hours on this server. Lastly, I believe I should be un-PKed as my punishment was harsh and unjustified. (PKed my char because of baseless claims from someone who couldn't accept the fact that I hustled them in-game, all in-character and without power gaming.)

You may only make one appeal per PK, if you are denied you will be unable to appeal for that character again.
You must appeal within one week of your character being PK'd, appeals posted after this time will be automatically denied.
You may only comment on an appeal if you were DIRECTLY involved with the situation leading up to the PK.
You must follow the provided template for the appeal, failure to do so will result in an instant denial.
You convinced someone that you are able to sell cars and transfer ownership to them. You knowingly lied about a game mechanic we don't have. You refused to listen and I explained to you multiple times. I told you to give the money back and you refused.
You said you don't own it, but you never said anything about actual transfer of ownership.

You are implying that it will stay, but never explicitly said that it WILL disappear once the actual owner leaves or recalls the car back. I think it's plainly unfair to deceive a new player like this. Only reason I PKed you was because you refused to give up the money.

You just agreed with me that I never told him he can transfer ownerships, but claim that I lied and talked about an in-game mechanic the server doesn't have, when in reality I actually did tell him that I don't own the car. The video clip didn't capture me saying "As long as the day is bright, the car shall remain" which means exactly what I said, I told him the car will not be gone, even if I leave the city which means exactly what I mean when I said "it'll stick around".
So to still say I told him he can transfer ownerships and to say that I lied to him to buy the car using power gaming is ridiculously and your taking this case personally and treating me with a personal biased.
How is it fair that you take this guy's word, without any evidence that I did said thing, punishing someone who didn't break any rules, PKing me cuz I didn't listen to you.
You keep saying I lied to him, I may have scammed the guy out of his money, buying a stolen car from me, but I used all in game methods and never once used OOC methods, or forcing him to buy the car OOC.
I didn't break any rules, I can literally say that til the cows come home but Rem, you still seem to say I broke a rule using strictly someones word, with no evidence. I just want to play the server without having to write an essay about how I was wrongfully punished.
What more do I need to say staff, I want Rem to show me where I power gamed, show me how I deceived this user, forcing them to buy the car OOC. This is just preposterous.

im the guy that captured the entire scene.
before i start, english isn't my first language and i'll try my best to make my statement undertstanble.
i dont know both parties and met them at the same day (can check logs to see guy f3 me by mistake and we continued to talk and we both added eachother on discord ).
he offerd me the car also and i rejected it because of the fact that he doesnt own the car and i'll get the chance to drive it only for this daytime
and all he mentiond to the victim at the video was pretty the same.
when i started to play mafia rp, what hooked me up was those rp scenarios that people create and loved when the RP is good.
i got robbed countless times for double the amount of this case,i may reported only twice- one guy that DC right after a deal n took my shit and 1 time guys camped my ship which isnt allowed
i am aware of the rules and the reason i was there from the first time is to capture it and help the victim.
after joining them i've noticed that the accused used ig rp so well that i didnt even thought that something is wrong cause he was telling him straight up "i dont own the car, the only place u can park in safetly is by renting a storage room"
at this point i was hooked to see how does this interaction will end so i also followed them. all went well in the RP matter and i was even surprised how the hell a guy that considerd jew IG gets husseld like that but then i realised when an individual wants something, he might ignore what ever been told to him and accept the deal with any condition just to drive it and show it off at the city i can guess the guy got bored of the car and just wanted his money back because it took time before admins admins took him to the roof (he was talking with me ig) but thats not the issue
i respect the diverge staffs and i think they're doing a great job and i've allways appericate their hard work and let them know on // so everybody know they can count on our good staff
and this case im viewing a side that i never viewed from a staff before
it feels like the accused being ignored and not taken seriously because no one even tried to look for any evidence hows the trade went
of course im just a user but im thinking as a staff and as an owner. u gotta give everyone a chance to explain the situation specially when its a donator that has love for the community and the server itself
i think the guy added a flavor to the time been spent and he done it fairly and the victim just mad about it and explained the whole situation to his favor
idk what are the options are but pk'ing and bannig for missunderstanding (or totaly ignorance by the victim) is harsh

I see what your saying, give him back what he paid for the car, I'd just like to make some things clear on my defense.
When you said I was "skirting", I don't actually know what that means but I can understand what your saying, that if someones new coming to the server and doesn't know what's going on can be a bit lost, but again how do I exactly know if someones new, guys said he had $60,000 on him, dudes almost got as much as me hahah.
I probably would have given the money back if the situation was handled a bit better, I felt like I didn't have much of a word in the situation like my word meant nothing, and the PK was before I talked with the user in OOC.
Next time I'll be 100% clear with something like this and I'll try my best to guide new players.
