Adding as Mr. Winchester's sort of boss, and as someone who's intimately familiar with mugging rules. I believe I shall interject by looking to the rules, as well as defining what you can and can't do in a mugging/kidnapping.
1. You may not mug in a public place, you can, however, pull a weapon on them and bring them to a secluded area to rob them (This can only be done when there is no one else around. EXAMPLE: The victim is alone at night in the middle of an empty street. You initiate a mugging with your firearm and take them to an alleyway so no one stumbles upon the crime. You may not perform the mugging in the street, which is a public area.)
You're not just mugging in the street, but in the middle of a parking lot with multiple cars parked there with a driver coming in to the middle space. A person who stumbled upon your crime.
There were plenty of other people present and around. Therefore, at least according to rule #1 of mugging rules, you cannot mug in a public space, which I'd argue the parking lot of the dock is, and there certainly were many people around. Multiple cars parked in that area, and one actively witnessing you attempting to mug. And before you state it's a kidnap attempt, more or less the same thing. So, I'd argue in this particular case, it shouldn't be P.K worthy, but one could even argue that it's fail RP. You logically wouldn't whip your guns out and attempt to mug or kidnap someone in a public space like a dock or pier, especially when there's multiple cars in the parking lot and a clear witness before you.
In addition, I'd argue that you wouldn't mug someone in broad daylight in front of multiple people, of which I count at least two other witnesses on the dock or in the parking lot especially without any masks on a pier/dock.
Rule #2 of Mugging/Kidnapping Rules:
Secluded and non public areas include; Alleys, dark corners, areas void of other players or NPCs/abandoned buildings.
He isn't breaking fear RP because he's in an area he shouldn't logically be able to be mugged/robbed. Now, if he were on his absolute lonesome, I could understand. But as I said, there were two other people/witnesses, as well as three cars in the parking lot. This is my view on such. Before you argue that you weren't going to mug him, but instead kidnap him, you argue earlier that he "ignored you because he had valuable items", indicating your intention, or at least the seem of it was to mug. Regardless, the rules more or less clearly outline what you can and cannot do for mug/kidnap. Other people were present.
