Shooting at someone and missing doesn't warrant you to execute them four minutes later when there is no threat. If you killed him instantly there could be an argument made that there was an active threat but you didn't. You waited four minutes and sniped him.

It wasn't a threat because he shot
If I run up to someone and spray at them and miss. A faction member backs up into cover and then shoots him, that faction member would be in the wrong?

Your faction member was not attacked, he was standing NEAR an individual who was attacked and killed. There was one bullet fired and that shot hit and killed a person not in any related factions to you and you didn't have his F3.
Even IF your faction member was attacked, you need to retaliate instantly, not hide and exact vengeance.
a. If the user is attacked they may flee and return later to exact revenge on the assailants as described under killing rule 3.
If you are ATTACKED, you may flee to exact vengeance. Not if someone who is your friend happened to stand near a shooting which he was completely unscathed and uninvolved, then returning four minutes later and sniping him... O_o

Kenneth Cassano walks into pharmacy and spits on Jordan Moretti thru VOIP to which Jordan reacts and shoots someone, missing, hitting and killing someone unrelated. To which you retaliate four minutes later. That also isn't allowed. Even though that doesn't warrant Jordan to escalate it into a gunfight, in my eyes it seems very obvious that you are baiting confrontation.
You may not attack/start confrontations with people in order to kill them when they defend themselves. This is considered baiting.
Furthermore, Jordan shooting at you was an ACTIVE THREAT. As per the rules you are not allowed to return later to exact vengeance after an active threat is over;
You are allowed to react to an Active threat in that moment (Not later when the situation is over) but do be aware that breaking fearrp to kill them and dying can result in a PK. (PK is circumstantial. View PK rules for more info)
Two wrongs don't make a right and I will punish Jordan for RDM as well.
