Im not talking about police rules, im talking about city law. I wasnt a cop. And that rule dosent apply as battery is a violent crime lol

Look Im literally throwing the book at you. It being battery in the eyes of the penal code means that cop and government rules apply as well. And I sent that to you, so we dont need to rehash that. He didnt punch you, he did what under the government rules is considered a non serious crime, therefore in order for that to be valid you would have had to have warned him.
